Copyright and takedown policy
How to report content on zome.io or a Zome-hosted page that infringes your copyright, what notices and counter-notices must include, and what Zome does next.
Zome respects the intellectual property rights of others and expects its customers and users to do the same. This policy explains how to tell us about content you believe infringes your copyright, and how we respond.
Our process follows the notice-and-counter-notice model of the US Digital Millennium Copyright Act (DMCA). We apply the same process to copyright complaints from anywhere, subject to the laws that apply.
What this policy covers
- content on zome.io, including text, images and video
- content on websites, booking pages and other pages that Zome hosts for its customers
- content that customers and users add to the Zome platform
Customers are responsible for the content they publish through Zome, but we act on valid notices about it as this policy describes.
The photographs and video on zome.io were created for Zome, many with AI image and video tools, or are licensed stock photography. If you believe any of them uses your work without permission, please tell us.
Sending a takedown notice
Send your notice through our contact page and label it "Copyright notice". To be valid, your notice must include:
- your physical or electronic signature, for example your typed full name
- a description of the copyrighted work you believe has been infringed or, if one notice covers several works, a representative list of them
- a description of the material you believe is infringing, with enough detail for us to find it, such as its exact web address
- your name, postal address, phone number and email address
- a statement that you have a good-faith belief that the use of the material isn't authorized by the copyright owner, its agent or the law
- a statement that the information in your notice is accurate and, under penalty of perjury, that you're the copyright owner or are authorized to act for the owner
Before you send a notice, consider whether the use might be allowed, for example as fair use. If your notice is missing information, we may ask you for it before we act.
What we do when we receive a valid notice
- We remove the material or disable access to it.
- We tell the customer or user who provided the material, and send them a copy of the notice. The copy may include your contact details.
- We keep a record of the notice for our repeat infringer policy.
Sending a counter-notice
If material you provided was removed and you believe it was removed by mistake or because it was misidentified, you can send a counter-notice through our contact page. Label it "Copyright counter-notice". It must include:
- your physical or electronic signature
- a description of the material that was removed and where it appeared before it was removed
- a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification
- your name, postal address and phone number
- a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, any judicial district in which Zome may be found, and that you'll accept service of legal papers from the person who sent the original notice or their agent
What happens after a counter-notice
We send a copy of your counter-notice to the person who sent the original notice. Unless they tell us within the time allowed that they've started a court action to stop the activity, we may restore the material no sooner than 10 and no later than 14 business days after we receive your counter-notice.
Repeat infringers
In appropriate circumstances, Zome will end the accounts or services of customers and users who repeatedly infringe copyright.
False or misleading notices
Under the DMCA, anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may have to pay damages, including costs and legal fees. If you're not sure whether material infringes your rights, consider getting legal advice before you send a notice or counter-notice.
Other intellectual property concerns
If your concern is about a trademark or another intellectual property right rather than copyright, contact us through our contact page with the details, and we'll review it.
For Zome customers
When you give us photos, logos, text or other material for your website, pages or profiles, you must own it or have permission to use it. Your own job photos are the safest choice. If we receive a valid notice about material on your pages, we'll follow this policy and let you know.
